COMPETITION RULES & REGULATIONS

Third Edition (“Competition”)

§1

General Provisions

  1. The Competition organiser is OKK Olga Kisiel-Konopka with its registered office in Warsaw, 03-687, ul.: WYSPOWA 2/32, Tax Identification (NIP) No.: 545-165-53-55 (the “Organiser”).
  2. The Competition will be conducted in compliance with the provisions of these Rules & Regulations (the “Regulations”), posted on the following website: https://www.paradyzdesigners.com (the “Competition Website”) and the binding and applicable national laws in force in the Republic of Poland, particularly the Polish Civil Code.
  3. This competition is not a game of chance, a prize lottery or a promotional lottery in the meaning of Article 2.1 of the Polish Gambling Law of 19 November 2009 (Polish Journal of Laws – Dz. U. 2009, No. 201, item 1540, as amended).
  4. The organiser is organising this Competition in agreement with and on behalf of Ceramika Paradyż sp. z o.o. with its registered office in Opoczno, at the following address: ul. Piotrkowska 61, 26-300 Opoczno, entered into the Register of Entrepreneurs of the National Court Register by the District Court for Łódź-Śródmieście in Łódź, 10th Commercial Division of the National Court Register (KRS) No.: 0000125109, however, the promisor of the prize in the meaning of Article 919 and 921 of the Polish Civil Code is the sole Organiser and it is on this Organiser that the fiscal obligations relating to the settlement of prizes in the Competition rest.
  5. Participation in the Competition is entirely voluntary. By submitting an entry in the Competition, the participant expresses consent to the provisions of the Rules & Regulations and accepts them unconditionally.

§2

Participants

  1. The Competition is open to adult natural persons (as at the date of the Competition announcement) with full legal capacity. The Organiser informs that an essential condition of participation in the Competition is pursuing the profession of architect, interior designer or designer or studying to pursue any of the above or convergent professions.
  2. The Organiser accepts teams comprising of at least two persons as the author of a visualisation constituting an element of the Competition entry. In such a case, each team must appoint a Team Leader who will submit the Competition Entry on behalf of the entire team.
  3. Persons meeting the above conditions who enter the Competition will hereinafter be referred to as a “Participant” or “Competition Participant”.
  4. The employees and representatives of the Organiser, entities contracted by the Organiser in connection with the organisation of the Competition, as well as of Ceramika Paradyż sp. z o.o. and their spouses, siblings, descendants, and ascendants may not participate in the Competition.

§3

Competition Duration

  1. The Competition launch will be posted on the Competition Website and on the Meta Platforms social media profiles of Ceramika Paradyż Sp. z o.o.: https://www.facebook.com/CeramikaParadyz  and https://www.instagram.com/ceramikaparadyz/
  2. The Competition will run from the moment it is published, that is, from 13 November 2023, until 28 March 2024 (“Competition Duration”).
  3. The deadline for the submission of Competition entries is 29 February 2024 at 23:59:59 hrs.

§4

Competition Task

  1. The Competition task (the “Competition Task”) comprises the creation of a 3D visualisation (the “Visualisation”) presenting a spatial arrangement using large format TRI-D sintered stone slabs. The Organiser allows for combining TRI-D sintered stone slabs with other collections (products) of the Paradyż brand (“Entry” or “Competition Entry”).
  2. Posting the Competition Task on the Participant’s social media channels (Facebook or Instagram) and using the competition hashtag: #zadaniekonkursowe and #paradyzdesigners3 is not mandatory. The post should be visible at least until the Competition results are announced by the Competition Commission. The social media profile of the Participant must be public throughout the duration of the Competition.
  3. Technical requirements of the Competition Entry:
  • Permitted file formats: .jpg or .png, max. 5 shots;
  • File resolution must be 300 dpi;
  • Maximum size limit per file: 10MB.
  • No logos are allowed, including logos associated with the Paradyż brand;
  • No text, captions, or subtitles, etc. are allowed;
  • The visualisation must respect all aspects of good building practice;
  • All other collections (products) used in the visualisation must be clearly specified;
  • Each Entry must be made in the form of a single project. Should an Entry comprise of several projections of the same premises/interiors, the inclusion of one collage summing up the whole premises on one graphic representation is permitted.

§5

Competition Execution

  1. The Competition Entry is submitted by the Participant via the entry form available on the Competition Website: https://www.paradyzdesigners.com
  2. The Participant provides the following particulars on the Competition entry form: their name, surname, email address, telephone number – exclusively for the purposes relating to the organisation of the Competition and for the possible granting of a license pursuant to § 8.3 of the Rules & Regulations.
  3. When submitting the Competition Entry, the Participant must decide on one of the following three categories: “Main”, “Special” or “Student Project”. Within the “Special” Category are the following subcategories: “Product”, “Interiors”, and “Outdoors”. The Participant selects the category where the Competition Entry will be submitted.
  4. The Competition Participant must specify the Paradyż product(s) used. The use of several products is allowed and the group of products or specific collections of the Paradyż brand must be clearly specified.
  5. The Entry must constitute the individual work of the Participant and must include the product textures of the Paradyż brand posted on the Competition Website.
  6. By accepting these Rules & Regulations and submitting a Competition Entry, the Competition Participant declares that they own the full copyright to the Entry content (subject to the rights of Ceramika Paradyż Sp. z o.o. to the textures mentioned in point  4) herein, and this may include the scope in which the Entry is the outcome of the work of other person(s) and is, in such a case, authorised to submit the Entry on behalf of the said person(s) and to collect the collect the Prize on their behalf.
  7. The Organiser stipulates that only Entries submitted via the entry form available on the Competition Website during the Duration of the Competition will be taken into consideration in the evaluation process of the Entries. An Entry is considered successfully submitted once it has reached the Organiser via the Competition Website.
  8. A Participant may submit more than one Entry in the Competition.
  9. The Organiser is entitled to request appropriate documents or declarations to be submitted by the Participant in order to verify the fulfilment of the criteria mentioned in §2.1 and § 7.2 of these Rules & Regulations.

§6

Prizes, Winners, & Tax on Competition Winnings

Prizes in the “Main” category with a total worth of €24,000

1st place with a total worth of €12,000, which includes:

  • Cash prize worth €10,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

2nd place with a total worth of €7,000 EURO, which includes:

  • Cash prize worth €5,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

3rd place with a total worth of €5,000, which includes:

  • Cash prize worth €3,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

Prizes in the “Special” category with a total worth of €9,000

Prize in the “Special” category – “Interiors” subcategory with a total worth of €3,000, which includes:

  • Cash prize worth €1,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

Prize in the “Special” category – “Product” subcategory with a total worth of €3,000, which includes:

  • Cash prize worth €1,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

Prize in the “Special” category – “Outdoor” subcategory with a total worth of €3,000, which includes:

  • Cash prize worth €1,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

Prize in the “Student Project” category with a total worth of €9,000

1st place with a total worth of €4,000, which includes:

  • Cash prize worth €2,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

2nd place with a total worth of €3,000, which includes:

  • Cash prize worth €1,000
  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000

3rd place with a total worth of €2,000, which includes:

  • Two-day trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000
  1. The Organiser stipulates that the dates of the planned trip to the 2024 Salone Internazionale del Mobile Furniture Fair in Milan will be provided at a later date, that is, by the day of announcement of the Winners. Within the award of the prize “Trip for one person to the 2024 Salone Internazionale del Mobile Furniture Fair in April 2024 worth €2,000”, the Organiser will cover the cost of tickets (to and from Milan), transport costs in Milan, and room and board.
  2. Should the winning Entry be made by a Participant/Winner on behalf of a team comprising more than one author of the visualisation, the awarded Competition Prizes are not subject to exchange for cash and may not be shared. For the avoidance of doubt, in such a case, the Organiser will indicate the person submitting the Competition Entry, that is, the Competition Participant, as the Prize Winner in the meaning of point 3, specifying that they are acting on behalf of the team, providing the names and surnames of the members of such a team. In the event of awarding a visualisation Competition prize, the co-authors of which are the members of a team in the above meaning, neither the Organiser nor the Promisor are accountable towards the co-authors of the visualisation on account of issuing them prizes or any parts thereof, and the accountability in this scope will be incurred by the Competition Participant submitting the visualisation Entry in the Competition. All non-cash prizes are not subject to exchange for a cash equivalent.
  3. In declining to accept the Prize by the Prize Winner(s) (“Winner” or “Winners”), they will not be entitled to any compensation, and the given Prize may be awarded to another Participant.
  4. If the Participant submitted more than one Competition Entry, the Competition Rules & Regulations allow for the possibility of awarding them more than one Prize in the Competition. The provisions of Article 4 apply accordingly.
  5. The issue of cash prizes is made by bank transfer to the bank account of the Winner within a term of 14 days from the day of announcement of the Competition results. If the Winner resides outside the borders of the Republic of Poland and does not hold a bank account in PLN, the Organiser will transfer the cash prize in PLN to the bank account specified by the Winner in the amount resulting from the wording of the Rules & Regulations, whereas any currency conversion will occur in accordance with the binding rules in force at the bank handling the account of the Winner.
  6. The Organiser is not responsible for failing to collect and execute the non-cash prizes in the event of the Competition Winner providing incorrect or untrue contact details or failing to respond within a term of 7 days in order to execute and collect the prizes despite the Organiser or Competition Partner making attempts to do so.
  7. The payment or award of the Prize will be made provided that the proprietary copyrights to the visualisation constituting an element of the Entry, in all fields of exploitation specified in §8.3 of these Rules & Regulations, are transferred to the Organiser in writing.
  8. In the case of Winners residing in the Republic of Poland and being tax resident in Poland, the Organiser, as the payer, will deduct from the Prize amount and pay to the appropriate tax authorities a flat-rate personal income tax of 10%.
  9. In the case of Winners residing in the Republic of Poland, an additional cash prize in the amount of 11.11% of the gross value of this prize (rounded up to a whole Zloty) will be awarded to all Prizes that, at the time of the award, will be deducted by the Organiser as the payer of 10% flat-rate personal income tax on the issued Competition Prizes and will be paid to the appropriate tax authorities competent in respect of the place of residence of the Winner. In such a case, the additional cash prize mentioned above will not be issued to the Prize Winner.
  10. In the case of Winners residing outside the borders of the Republic of Poland, the settlement of taxes on the Prize will be carried out as follows:
    1. Should the Winner hold a tax residency certificate in the country of residence (“Certificate”), they are required to send the Organiser a scan of the Certificate with a certified translation to the Polish language. If the Republic of Poland has signed a double taxation treaty with the country of residence of the Winner, and the said agreement provides for the settlement of tax solely and exclusively in the Winner’s country or residence, the Winner is required to individually settle and pay the tax on the Prize in their country of residence.
    2. In the case of Winners with no such Certificate or who fail to submit it immediately after being notified of the winnings, the Organiser will settle and pay the tax in the Republic of Poland, in accordance with the rules set out in point 7 and 8 of this paragraph.
  11. The Participant accepts these Rules & Regulations and, by submitting their Competition Entry, represents that none of the activities associated with submitting the Entry, particularly including the creation of the visualisation constituting the Competition Task, are executed within possibly carried out business activities conducted by the Participant.

§7

Announcement of Competition Winners & Issue of Prizes

  1. The Entries will be evaluated by the Competition Commission comprising: Jürgen Hermann Mayer – Chairman, Agnieszka Kalinowska-Sołtys, Ewa Porębska, Aldona Chudzicka, Didier Faustino, Oskar Zięta, Alek Pluta, David Basulto, Szymon Hanczar, Przemo Łukasik, Magdalena Federowicz-Boule, and Joanna Jurga. The Competition Commission will select the Winners – Prizes in the following categories: “Main”: one winner of the prize for 1st place; one winner of the prize for 2nd place; one winner of the prize for 3rd place; one winner of the prize in the “Special” category, “Interiors” subcategory; one winner of the prize in the “Special” category, “Product” subcategory; one winner of the prize in the “Special” category, “Outdoor” subcategory, and prizes in the “Student Project” category: one winner of the prize for 1st place, one winner of the prize for 2nd place, and one winner of the prize for 3rd place.
  2. The criterion for the selection of the Winners are as follows: originality and creativity of the executed 3D visualisation, the marketing potential of the visualisation for the Organiser and the Prize Promisor, and the creative utilisation of materials (textures) made available by the Organiser. Furthermore, in the “Student Project” category, only the works of students under 30 years of age studying in architecture-, interior design-, and design-related fields will be evaluated.
  3. The Competition Winners will be announced on 28 March 2024 in the form of a list of Competition Winners.
  4. The list of Prize Winners, together with the publication of the winning Entries – visualisations – with the provision of the name and surname of the Winner and – with potential consent – the image of the Winner will be posted on the Competition Website. The Organiser allows for the possibility of the public disclosure in writing of the list of participants, including the Prize Winners with the awarded distinguished visualisations as a catalogue of inspirations in printed form, as well as the publication of such a catalogue in electronic form on the website: www.paradyz.com and https://www.paradyzdesigners.com or in other promotional materials of the Paradyż brand, online or in printed form.
  5. The Participants will also be notified of being granted the Prize by email sent by the Organiser to the email address provided in the entry form. Furthermore, the Participant will receive a new form comprising of an agreement transferring the proprietary rights to the visualisation constituting an element of the Entry, in the fields of exploitation mentioned in §8.3.
  6. The Organiser reserves the right to limit the number of prizes issued in the Competition.
  7. The Prize Winner, in order to collect the Prize and for the purposes of paying the tax on the Prize, should send the following particulars to the email: hello@paradyzdesigners.com: name, surname, address of residence, contact telephone number, bank account number and, possibly – at the Organiser’s request – other information required to issue the Prize and/or settle the tax.
  8. The Prize Winners may also, subject to the will of the Organiser, receive an invitation to a gala where the Prizes will be symbolically conferred. The gala will take place in Poland at a time and place specified by the Organiser.
  9. The Organiser will contact the Prize Winners by email within a maximum term of 7 working days from the receipt of a signed copy of the agreement transferring the proprietary copyrights to the visualisation constituting an element of the Entry, in order to establish the details of issue of the Prize and obtain the information required under §7.7 of the Rules & Regulations.
  10. Failing to submit a signed copy of the agreement mentioned in point 9 herein within a term of 7 days or failure to respond to the email received from the Organiser within a term of 7 days and/or failure to provide the data required under §7.5 of the Regulations will result in the loss of the Prize.
  11. The Organiser is entitled to exclude a Participant from the Competition, at any stage of its duration, in the following circumstances:
    1. A breach of the provisions of these Rules & Regulations;
    2. Attempting to influence the Competition results in any manner that extends beyond the Rules & Regulations; and
    3. A breach of copyrights or other rights of third persons.

§8

Representations of the Participant & Transfer of Copyrights

  1. The submission of a Competition Entry by the Participant is tantamount to the Participant assuring that they hold exclusive and unlimited copyrights to the Competition Entry, particularly including the submitted Visualisation.
  2. The submission of a Competition Entry by the Participant is tantamount to the Participant assuring that the Visualisation is free of any legal defects and claims or other third party rights, and that it does not infringe on any rights or legally protected personal rights of third persons. Should the above-mentioned assurance of the Participant turn out to be untrue, the Participant discharges the Organiser from liability on account of this and undertakes to bear all consequences resulting from this fact.
  3. Once the Participant has submitted a Competition Entry, they grant the Organiser a royalty-free, non-exclusive, territorially unlimited license, with the right to grant a sublicense to use the Visualisation as a work (the whole or any part thereof) for a fixed period of 5 years, and subsequently – after the expiry of 5 years – for an unlimited time, provided that the Participant will be entitled to terminate the license granted for an unlimited time with a 2-year term of notice, in the following fields of exploitation:
    1. Recording, duplication, and publishing the work in the press and online (including social media: Facebook, Instagram, LinkedIn, YouTube, and Pinterest);
    2. Duplication using any printing and polygraphy techniques in the form of prints, folders, charts, posters, announcements, banners, etc., public performance, exhibition, broadcasting, and re-transmitting;
    3. Making the work available to the public so that anyone can access it at a time and place chosen by them (including online), irrespective of the amount of emissions and copies produced;
    4. Placing on the market and lending the original or copies thereof;
    5. Use for promotional and advertising purposes, particularly for such purposes of the Promisor of Prizes;
    6. Expressing consent to elaborate the work(s) encompassed by the Competition Entry and for the disposition and use of such elaborations, as well as for the use of the works or their parts in other works for the purposes described in point 1-5 hereinabove;
      1. Execution on the basis of the Visualisation of the spatial arrangement, e.g., in showrooms etc.;
      2. Granting of sublicenses to third parties in all fields of exploitation specified above. The Winner of the Prize, in exchange for receipt of the Prize, will transfer to the Organiser in writing the whole proprietary copyrights to the 3D Visualisation created thereby in the fields of exploitation mentioned hereinabove, without time or territorial limitations.
  4. The Participant retains the proprietary copyrights to the Visualisation and the Organiser undertakes that when using the Visualisation in any manner from among the fields of exploitation specified in §8.3 of the Rules & Regulations, will mark the work with the name and surname of the Participant.
  5. The fact that the Organiser has obtained the proprietary copyrights to the works encompassed by the Competition Entries does not give rise to the obligation on the part of the Organiser of using them in any field of exploitation mentioned hereinabove.

§9

Complaints

  1. A Participant is entitled to submit a complaint in relation to the manner of conduct of the Competition.
  2. Complaints should be submitted to the Organiser to the following correspondence address of the Organiser: OKK Olga Kisiel-Konopka, Warsaw 03-687, ul. WYSPOWA 2/32, providing a return correspondence address or, alternatively, it may be submitted by email to the following email address: hello@paradyzdesigners.com
  3. Complaints can be made for the entire Duration of the Competition and for a term of 14 days from the date of announcement of the Competition results.
  4. A complaint submitted by a Participant should contain the name and surname, correspondence address, reason and scope of the complaint, as well as the content of the request. The complaint should be signed or else will not be considered.
  5. The Organiser considers complaints within a term of 14 working days from the date of their receipt. The Organiser will notify the Participant of the manner of consideration in the form in which it received the complaint.

§10

Processing of Personal Data

  1. The personal data of the Competition Participants will be processed pursuant to Regulation (EU) No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).
  2. The Competition Participant personal data controller is the Organiser.
  3. The basis for the processing of the Competition Participant’s personal data is the legitimate interest of the Organiser resulting from the execution of the terms and provisions of the Rules & Regulations and the voluntary entry of the Participant in the Competition. The basis for the data processing is also the legitimate interest of the Organiser consisting of the consideration of complaints and, in the scope necessary to fulfil tax obligations, appropriate provisions of the law.
  4. The provision of data is voluntary but if they are not provided, the Competition Participant will not be entitled to participate in the Competition or to receive prizes.
  5. The personal data of the Competition Participants are processed by the Organiser for the entire duration of the Competition, its conclusion, the conferral of prizes, and the consideration of complaints and then, for archiving and accounting purposes for the term required by applicable provisions.
  6. The Competition Participant is entitled to access their personal data, they have the right to rectify them, delete them or restrict their processing and the right to transfer the data.
  7. The Competition Participant is entitled to file a complaint to the President of the Office for Personal Data Protection in relation to the processing carried out by the Organiser.
  8. The personal data of the Participants are not subject to automated decision-making processes (including profiling).
  9. The personal data of the Competition Participant may be transferred  to Ceramika Paradyż sp. z o.o. for the purposes relating to the conduct of the Competition and for the promotional purposes of  Ceramika Paradyż sp. z o.o., third party suppliers (e.g., entities providing IT services), entities with the support of which the Competition is being organised, accountants, the courier company and – subject to legal provisions – public administration authorities and courts.
  10. Requests for more information on the execution of rights concerning data processing or in relation to any other queries are to be sent to the following email address: hello@paradyzdesigners.com or by post to the correspondence address of the Organiser specified in § 1.1 of these Rules & Regulations.

§11

Final Provisions

  1. The Organiser reserves the right to change the Rules & Regulations at any time, provided that such a change will not prejudice the rights already acquired by the Competition Participants. Any changes to the Rules & Regulations will apply once the amended version thereof is posted on the Competition Website.
  2. The provisions of the Civil Code apply in all matters not regulated by the Agreement.
